Copyright and DMCA Policy

Lumina respects the intellectual property rights of others and expects users of the Lumina service to do the same. This Policy sets out the procedure for notifying us of alleged copyright infringement, consistent with the United States Digital Millennium Copyright Act, 17 U.S.C. § 512, and analogous provisions of other applicable law.
1. Designated Agent
Notices must be addressed to the Designated Copyright Agent: Lumina, Attn: Copyright Agent, Galveston, Texas, United States, email legal@lumina.app.
2. Contents of a Notice of Infringement
A valid notification must include substantially the following: (a) a physical or electronic signature of the owner or a person authorised to act on the owner's behalf; (b) identification of the copyrighted work claimed to have been infringed, or a representative list where multiple works are covered; (c) identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate it, including the account, chat, document or gallery reference; (d) contact information for the complaining party, including address, telephone number and email address; (e) a statement that the complaining party has a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorised to act on behalf of the owner.
3. Our Response
Upon receipt of a compliant notice we will expeditiously remove or disable access to the material identified and will take reasonable steps to notify the affected user of the removal, providing a copy of the notice.
4. Counter-Notification
A user who believes material was removed as a result of mistake or misidentification may submit a counter-notification containing: (a) the user's signature; (b) identification of the material removed and its former location; (c) a statement under penalty of perjury of a good-faith belief that the material was removed as a result of mistake or misidentification; and (d) the user's name, address and telephone number, together with consent to the jurisdiction of a competent court and to accept service of process from the complaining party. We may restore the material not less than ten (10) and not more than fourteen (14) business days after receipt, unless we are informed that judicial relief has been sought.
5. Repeat Infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are the subject of repeated valid infringement notices.
6. Misrepresentation
Any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and legal fees.
7. Generated Output
Output produced by generative models may resemble existing works. You are responsible for conducting your own clearance before commercial use of Output, and for ensuring that any material you upload as a reference or for restoration is material you are entitled to use.
